A BILL to amend and reenact section thirteen-b, article nine-a,
chapter eighteen of the code of West Virginia, one thousand
nine hundred thirty-one, as amended, relating to
establishing an allowance for a public employees insurance
reserve fund, benefits and other current expense and
substitutes during the school year beginning the first day
of July, two thousand, only; calculation of such allowance;
distribution of such allowance; establishing an allowance
for a public employees reserve fund, professional educators,
service personnel, fixed charges, other current expense and
substitute employees and improvement of instructional
programs during the school year beginning the first day of
July, two thousand one, and each school year thereafter; calculation of such allowance; distribution of such
allowance; and eliminating the allowance for remedial and
accelerated education programs and salary equity.
Be it enacted by the Legislature of West Virginia:
That section thirteen-b, article nine-a, chapter eighteen of
the code of West Virginia, one thousand nine hundred thirty-one,
as amended, be amended and reenacted to read as follows:
ARTICLE 9A. PUBLIC SCHOOL SUPPORT.
§18-9A-13b. Allowance for public employees insurance reserve fund, salaries, benefits, other school expenses;
calculation; distribution.
(a) Commencing with the school year beginning on the first
day of July, two thousand, only, funds which accrue from
allocations due to changes in net and adjusted enrollment above
that computed for the preceding school year shall be allocated in
the following manner:
(1) Up to eighty percent of these funds shall be allocated
to the state department of education for a public employees
insurance reserve fund in addition to the amount allocated to the
public employees insurance agency pursuant to subsection (a),
section twenty-four of this article;
(2) Twenty percent of these funds shall be allocated for
other current expense or substitute costs in addition to the amounts allocated under section nine of this article; and
(3) The balance shall be allocated for other employee
benefits, pursuant to subsections (2), (3) or (4), section six of
this article.
(b) Commencing with the school year beginning on the first
day of July, two thousand one, and thereafter, funds which accrue
from allocations due to changes in net and adjusted enrollment
above that computed for each preceding school year shall be
appropriated by the Legislature and shall be allocated to one or
more of the following:
(1) An allowance for a public employees insurance reserve
fund allocated to the state department of education which shall
be in addition to the amount allocated to the public employees
insurance agency pursuant to subsection (a), section twenty-four
of this article;
(2) An allowance for professional educators in addition to
the amounts allocated under section four of this article;
(3) An allowance for service personnel in addition to the
amounts allocated under section five of this article;
(4) An allowance for fixed charges in addition to the
amounts allocated under section six of this article;
(5) An allowance for other current expense and substitute
employees in addition to the amounts allocated under section nine
of this article; and
(6) An allowance to improve instructional programs in
addition to the amounts allocated under section ten of this
article.
